1. Scope and contracting parties
1.1 These General Terms and Conditions (GTC) apply to all orders placed via our online shop gartenort.de.

1.3 The seller, contractual partner and invoice issuer for the ordered goods is the company identified for the respective order in the checkout, in the order overview, in the order confirmation or on the invoice.
1.4 Berlin Marketing Group LLC operates the website and supports customer service. However, the contractual partner for the purchase agreement is the seller specified for the individual order.
1.5 For consumers, the mandatory legal provisions of the state of their habitual residence apply, insofar as these are applicable.
2. Conclusion of the contract
2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
2.2 By submitting the order, the customer makes a binding offer to conclude a purchase agreement.
2.3 The purchase contract only comes into effect when the order is expressly confirmed or the goods are shipped.
3rd Prizes
3.1 The prices displayed in the online shop at the time of ordering apply.
3.2 For international shipments from a third country, additional duties, taxes, or fees may apply during import. Unless these are already included in the order price or explicitly marked as covered during checkout, they are to be borne by the recipient.
3.3 Import-related processing can be handled by a carrier, freight forwarder, or import service provider commissioned by the seller, shipper, or supplier. This may include, in particular, customs declaration, import processing, and, where applicable, advance payment of duties and fees.
3.4 To the extent permitted by law, import duties, taxes, fees or related service and processing charges advanced by the commissioned carrier, freight forwarder or import service provider may be passed on to the customer or recipient.
3.5 The seller will only assume or reimburse such import-related costs if this has been expressly stated before the order was placed.
3.6 Delays, additional costs or returns resulting from the customer or recipient's failure to provide necessary information, cooperation or payments in connection with the import in a timely manner shall be borne by the customer or recipient, to the extent permitted by law.
4. Payment
4.1 The customer may use the payment methods displayed at checkout.
4.2 Payment processing is handled via external payment service providers.
5. Delivery and Cancellation
5.1 Delivery times, shipping methods and shipping costs are as stated on the website and in the checkout.
5.2 Cancellation is possible as long as the order has not yet been processed or handed over to the shipping provider. Once the order has been processed or shipped, cancellation is no longer possible. Consumers are then subject to the statutory rights of withdrawal as set out in the cancellation policy.
6. Cancellation and Returns
6.1 Consumers have a statutory right of withdrawal in accordance with our cancellation policy.
6.2 The right of withdrawal must be exercised by a clear declaration, for example by email to info@gartenort.de.
6.3 Unless otherwise stipulated in the cancellation policy, the customer shall bear the direct costs of the return shipment, unless the goods are defective, damaged or have been delivered incorrectly.
6.4 Refusal to accept or failure to collect a shipment does not automatically constitute a valid cancellation. If additional return shipping costs, storage costs, service fees, disposal costs, or other costs arise as a result of refusal to accept, failure to collect, failure to cooperate with delivery, or failure to pay import-related duties, these costs may – to the extent legally permissible and provided the customer has been transparently informed in advance – be deducted from the refund amount or invoiced to the customer separately.
7. Warranty
7.1 The statutory warranty rights apply.
7.2 Consumers are requested to inspect the goods upon receipt for obvious defects and transport damage and to report any complaints as soon as possible. This does not affect the customer's statutory rights.
8. Liability
8.1 The seller's liability is unlimited only in cases of intent, gross negligence, and damages resulting from injury to life, body, or health.
8.2 In the event of a slightly negligent breach of essential contractual obligations, the seller shall only be liable for the foreseeable damages typical for this type of contract. Essential contractual obligations are those obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance the customer may regularly rely.
8.3 Furthermore, the seller's liability for damages caused by slight negligence is excluded.
8.4 To the extent that the seller's liability is excluded or limited, this also applies in favor of his legal representatives, employees, agents and other representatives.
8.5 Liability under mandatory legal provisions remains unaffected.

10. Alternative Dispute Resolution
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless mandatory law requires otherwise.

11.2 The customer can save or print these Terms and Conditions before submitting the order. The order details and the legally required consumer information will be provided as part of the order processing.
